Nagpur HC Orders Decision on Ramdaspeth-Kachipura Land Lease Plea Within 8 Weeks

Nagpur: The Nagpur Bench of the Bombay High Court has directed the concerned authorities to take a final decision within eight weeks on a long-pending application seeking a lease of land in the Ramdaspeth-Kachipura area.
Vidarbha City Club Director Harish Shakya had approached the High Court after his application, submitted nearly seven years ago, remained undecided.
Shakya had applied for the land under the Expression of Interest scheme on September 9, 2019, proposing projects focused on the welfare of farmers in Vidarbha. On the same day, he also submitted a representation to the Governor.
The Governor’s office subsequently directed the concerned authority to take appropriate action. However, according to the petition, no final decision was communicated despite repeated follow-ups by Shakya between 2022 and 2026.
Shakya also approached Dr Punjabrao Deshmukh Krishi Vidyapeeth (PDKV) regarding the proposed lease but allegedly received no decision despite reminders.
A Division Bench comprising Justice Anil Kilor and Justice Raj Wakode took note of the prolonged delay and directed the concerned authority to decide Shakya’s September 9, 2019 application and related complaints within eight weeks.
The authority has further been directed to communicate its decision to Shakya within two weeks after taking the decision. The court subsequently disposed of the petition.

Land History Dating Back to 1883
According to the petition, approximately 650 acres of land in Ramdaspeth-Kachipura was leased to Kachi farmers for agricultural purposes in 1883. The land was subsequently transferred to Dr Punjabrao Deshmukh Agricultural University in 1968-69.
The petition states that around 52 acres of the land is currently lying unused.
Shakya’s proposal sought to utilise the land for several farmer-oriented facilities, including low-cost accommodation for farmers, grain and agricultural produce storage, a hostel for farmers’ children, a hospital, and sports and recreational facilities.
The proposal was submitted to the Governor and the agricultural university in 2019. The petition alleged that despite directions from the Governor’s office and repeated representations over the years, the application remained pending.
