High Court Relief Ends, State Says Go… Why Is Kachipura Still Standing?

Nagpur: The proposed demolition drive against illegal commercial structures standing on the prime land of Dr. Panjabrao Deshmukh Krishi Vidyapeeth (PDKV) at Kachipura has once again come to an unexpected halt. Despite the State Government approving the demolition and earlier legal hurdles having been cleared, the civic body’s failure to proceed has raised fresh questions.

Is the delay merely due to three newly filed appeals, or are there deeper legal or administrative factors behind the pause?

According to official documents of the Nagpur Municipal Corporation (NMC), the Dharampeth Zone has chosen not to rush into demolition. Instead, it is seeking legal clarity before taking any irreversible action. Assistant Commissioner Rajkumar Meshram has written to the Town Planning and Legal Departments on July 3 and July 13, requesting formal opinions on whether the newly filed appeals or any pending judicial proceedings could legally obstruct the demolition.

A Decade-Old Encroachment Dispute-
The dispute concerns nearly 8,051.44 square metres of PDKV land bearing Khasra Nos. 204 to 209, where 54 commercial establishments have been operating for years. These include automobile workshops, garages, restaurants, timber units and a marriage lawn.

The matter remained stalled for almost a decade after a court granted interim protection in 2016. Recently, the State Government ruled in favour of the municipal corporation, paving the way for demolition. However, the filing of three fresh appeals has once again slowed the process.

Administration Verifying High Court Status-
Officials are also verifying whether any proceedings related to the matter are pending before the High Court or any other competent authority. Civic officials are keen to avoid a situation where demolition is carried out first, only to face an adverse judicial order later. Consequently, the administration has adopted a cautious approach until the complete legal position is confirmed.

Speculation Grows, But No Official Evidence-
The delay has triggered widespread speculation in and around Kachipura. While some residents believe the pause is part of routine legal procedure, others suspect possible administrative pressure or political influence. Another view is that affected traders have simply exercised their legal right to seek judicial relief.

However, there is no official confirmation supporting allegations of political interference, nor has any public evidence emerged linking any political leader, minister or elected representative to the delay.

Why the Civic Body Is Proceeding Carefully –
Legal experts believe the NMC is determined to avoid any procedural lapse that could jeopardise the entire demolition exercise in court. The corporation is therefore expected to take a final call only after receiving written opinions from both the Legal and Town Planning Departments.

What Happens Next?
If the three fresh appeals fail to secure a stay and the Legal Department gives a clear opinion favouring demolition, the civic body may resume the bulldozer drive. However, if any competent authority or court grants interim relief, the operation could once again be deferred.

Based on official documents and administrative correspondence reviewed by Nagpur Today, the immediate reason for the delay is the filing of three new appeals and the municipal corporation’s effort to verify their legal implications. At present, there is no official record or public evidence substantiating claims of political interference or pressure from any minister or public representative.
For now, all eyes remain on the NMC’s legal opinion and the administration’s next move in the long-pending Kachipura demolition case.
