Thane tribunal awards Rs 23.83 lakh to man who lost arm in road accident
A Motor Accident Claims Tribunal (MACT) in Maharashtra’s Thane district has awarded compensation of Rs 23.83 lakh to a 45-year-old man who lost an arm in a road accident more than four years ago, reported PTI.
A copy of the order dated August 13, passed by Tribunal Member V S Deshmukh in Kalyan, was made available on Sunday.
According to the claim, Jagan Rama Jadhav was riding a scooter on the Kalyan-Murbad road when a truck crashed into his two-wheeler.
His left arm was severed in the accident.
Tribunal holds truck driver responsible
While the insurance company sought to blame Jadhav for the accident, the tribunal held that the spot inspection report and FIR clearly established that the truck driver was at fault.
The tribunal also held that Jadhav had suffered a 60 per cent loss of earning capacity as a result of his injuries, reported PTI.
Compensation with 6 per cent annual interest
The tribunal directed that Rs 23.83 lakh be paid to Jadhav as compensation, along with interest at the rate of 6 per cent per annum from the date of filing of the application until the amount is realised.
Thane tribunal awards Rs 10.37 lakh to family of hotel waiter killed in 2010 road crash
The Motor Accident Claims Tribunal (MACT) in Thane has awarded Rs 10.37 lakh compensation with 7.5 per cent annual interest to the family of a hotel waiter killed in a 2010 road crash.
Fatal crash
On October 16, 2010, Daulat Thakare was riding pillion on a motorcycle when a speeding truck hit the vehicle, killing him. Police booked the truck driver, following which Thakare’s widow, two minor sons, and parents filed a petition seeking R20 lakh.
Claim contested
The insurer opposed the claim, alleging a fake policy cover note, lack of valid truck permits, and negligence by the motorcyclist.
Defence rejected
Rejecting the arguments, the tribunal held truck owner Gajanan T Thakur and the insurance company jointly liable, directing them to deposit Rs 10,37,408 for the victim’s family. The tribunal observed, “It is crystal clear that the rash and negligent driving of the driver of a motor truck can be demonstrated based on the location on site.”
